4. What Are the Responsibilities of a Vessel Agent?
A vessel agent is the representative appointed by the principal to perform ship agency services. According to maritime law, the vessel agent’s responsibilities include:
- Taking all necessary actions to properly protect the lawful rights and interests of the principal.
- Complying with the principal’s instructions and requirements.
- Accurately calculating all collections and disbursements.
- Promptly notifying the principal of events related to the entrusted work.

According to Article 239 of the 2015 Vietnam Maritime Code:
- The principal is responsible for guiding the vessel agent in carrying out the entrusted services when necessary and must provide advance funds upon the vessel agent’s request for anticipated expenses.
- If the vessel agent acts beyond the entrusted scope, the principal shall still bear responsibility if, immediately after receiving such information, the principal fails to notify relevant parties that they do not recognize the agent’s action.
Claims related to cargo damage or loss under bills of lading or transportation contracts can only be decided by the principal, so early resolution is highly recommended.
